A gay and transgender-inclusive hate crime bill has been introduced in the Georgia House of Representatives, while a bill requiring HIV testing of prisoners was introduced in the state Senate. Rep. Pedro "Pete" Marin (D-Duluth) had put forth the hate crimes bill, H.B. 111. It would offer sentence enhancement for hate crimes motivated by the victim's "race, religion, gender, gender identity, sexual orientation, or national origin."

Why: The Senate will begin debate next week on the Economic Recovery bill, which was passed by the House of Representatives this week. The Senate bill includes $400 million in funding for HIV and STD screening and prevention. (The House version is $335 million and includes TB and Viral Hepatitis as well. We will call for inclusion of those diseases in conference). We must make certain the funding remains in the bill. 56,300 new HIV infections occur annually.
One state plans to close all STD clinics due to budget cuts
More than 680 jobs have been lost in TB control programs in last three years At least 3 million Americans are chronically infected with hepatitis C 25% of the current public health care workforce is eligible to retire in 2012. The money should be sent to the Center for Disease Control and Prevention's (CDC's) National Center for HIV/AIDS, Viral Hepatitis, STD, and TB Prevention to address the four most common infectious diseases in the U.S. Adjusted for inflation, CDC's HIV prevention budget alone has decreased by 19.3% since fiscal year 2002. Explain to the Administration and the Senators that prevention funding is critical to the health and well-being of the country.

In the wake of what is believed to be the state's first same-sex divorce filing, LGBT legal experts again advised caution for gay and lesbian couples from Texas who are considering marriage. Same-sex marriage is currently legal only in Massachusetts and Connecticut, and both states allow out-of-state couples to marry there. But both also have residency requirements for divorce, meaning couples from out of state may not be able to undo their vows. Massachusetts, for example, requires that a married couple live in the state for one year before obtaining a divorce. Courts in Rhode Island and Oklahoma have denied divorces to same-sex couples married in other states. And New York is the only state that has indicated it will recognize out-of-state same-sex marriages. Jenny Pizer, director of Lambda Legal's National Marriage Project, said it's an issue the LGBT civil rights group has dealt with as far back as 2000, when Vermont legalized civil unions for same-sex couples from out of state. -NH Gay Bill Shelved

(Concord, New Hampshire) A bill that would have mandated that partners in civil unions be added to all state insurance laws was put on hold just as House committee was about to hold a hearing on the measure. Rep. Edward Butler (D), the bill's sponsor, pulled the legislation, saying there were other measures dealing with same-sex couples that should be considered first. Among those is a proposal to change New Hampshire's year old civil union law to allow for full marriage. A hearing on that bill is scheduled for Feb. 5. Republicans have filed a bill that would start the process to amend the state constitution to ban same-sex marriage and the legislature will consider a bill that would maintain civil unions and direct the government to recognize civil unions and gay marriages performed in states and countries where they are legal as civil unions in New Hampshire. Avon and lesbian: Not two words you'd usually expect to hear in the same sentence. But that's only if you don't know Daryn DeZengotita. DeZengotita, of Dallas, is one of five Avon sales representatives chosen about two years ago to serve as the "faces of Avon" around the world in an advertising and marketing campaign. Now that commercial is going to get one of the largest television audiences of the year when it airs Sunday, Feb. 1, during the Super Bowl. "It was about two years ago that I was selected to audition for - and got a part in - some national TV commercials for Avon," DeZengotita said this week. "There are a million Avon representatives in the United States. Fifty of those were chosen to audition, and 10 were selected to be in the commercials." Read more

It's not too early to look forward to the fight for the 2012 Republican presidential nomination.
In the absence of a party leader with an outsized, charismatic personality -- think House Minority Leader Newt Gingrich circa 1993 -- a minority party has a hard time defining itself. And, like it or not, its presidential candidates tend to become the face of the party. [...] Running first was the party's 2008 vice presidential nominee, Alaska Gov. Sarah Palin, with 67 percent wanting her to run; 30 percent did not want her in the 2012 race. Next came former Massachusetts Gov. Mitt Romney with 62 percent (32 percent opposed), and former Arkansas Gov. Mike Huckabee with 61 percent (33 percent opposed). [...] In fourth place was Army Gen. David Petraeus with 49 percent (39 percent opposed). He was followed by another 2008 candidate, former New York City Mayor Rudy Giuliani at 48 percent (47 percent opposed). The final five drew more opposition than support. Gingrich got the nod from 47 percent (48 percent opposed). Next were Louisiana Gov. Popular DJ Peter Rauhofer enraged local gay activists last fall when he produced a South Beach "Main Event" dance party in direct competition with White Party Week's Noche Blanca AIDS fundraiser. Now, national gay activists are angry with Rauhofer: He is reprising his Main Event party at Mansion on March 1 opposite the National Gay and Lesbian Task Force's Winter Party Orbit fundraiser at Cameo. "It hurts the community. That's what it comes down to,'' said Chad Richter of Miami Beach, festival chairman of this year's Winter Party. "We have volunteers who are working hard all year long. To have someone who is also gay and is doing a competing event, it's almost hard for a lot of people to believe." Austrian-born Rauhofer, pictured above on his Sexy album, did not respond to several Miami Herald e-mails requests for comment. Winter Party began in Miami Beach in 1994 with a one-day beach dance event off Ocean Drive. It helped finance a new foundation to benefit local gay groups. The Task Force bought the event, as well as the foundation's annual autumn recognition dinner, after the fundraising group went under in 2004. The Task Force agreed to keep two-thirds of all net profits from the events in Miami-Dade County, giving the money to the Dade Community Foundation's GLBT Community Project Fund.

-Miami No Place to Pee for Transgender People
When it comes to safe bathrooms for people identifying as transgender, Miami is no paradise.
The Florida city has the fewest safe toilets of all major U.S. municipalities, reports the Miami New Times. The newspaper based its pronouncement on a list originated by Safe2Pee.org, a group that tracks gender-neutral facilities across the country -- which include bathrooms that aren't marked with men/women signs or are labeled unisex. Many transgender people have experienced harassment, violence, and discrimination when utilizing a public bathroom that is specifically designated for either men or women.

The program, entitled "Education for Citizenship," instructs teachers to "revise the student's attitude towards homosexuality" and to teach children to reject "existing discrimination for reason of sex, origin, social differences, affective-sexual, or whatever other type" and to carry out a "critical evaluation of the social and sexual division of labor and racist, xenophobic, sexist, and homophobic social prejudices." The Catholic Church and numerous individuals have protested the program, which is mandatory throughout Spain, including the nation's private schools, although the latter have the option of ignoring individual directives in the program. The case before the Spanish Supreme Court is an appeal of a decision of the highest court of the Spanish Province of Andalucía, which ruled that people may sue to prevent their children from being indoctrinated in the program, but later ruled against a particular group of families seeking exemption. -Louisiana Court of Appeal Upholds Benefits for Same-Sex Partners of New Orleans City Employees

'The appeal by ADF left New Orleans city employees and their families in unnecessary legal suspense for a year.'
The Louisiana Court of Appeal, Fourth District, has upheld a Lambda Legal victory in lower court that the city of New Orleans was within its authority when it granted health benefits to domestic partners of city employees and established a domestic partner registry for city residents. The January 15 decision came a year to the day that the Civil District Court for Orleans Parish ruled that the State Constitution does indeed grant the city of New Orleans the authority to offer health benefits to the domestic partners of city employees and maintain a registry of domestic partners for city residents. The anti-gay Alliance Defense Fund (ADF) appealed that ruling, saying that the registry violated state laws prohibiting marriage for same-sex couples and that local governments lack the authority to govern such arrangements, but the Court of Appeal rejected those arguments. The three-judge panel wrote: "The registry ordinance has no effect on the Civil Code articles relating to marriage, creates no obligations between the parties who choose to register, and provides neither an enforcement mechanism nor a cause of action for which redress may be sought in courts of this state." -Rights Groups Release Updated Guide for New York Same-Sex Couples Married Out of State

Lambda Legal, Empire State Pride Agenda, New York Civil Liberties Union and the American Civil Liberties Union have released a guide outlining government protections and obligations for same-sex couples in New York who married out of state. The updated guide is released as the first anniversary of Martinez v. County of Monroe draws near, and in light of last week's decision in Lewis v. New York State Dept. of Civil Service - both notable appellate court rulings that upheld government recognition of out-of-state marriages of same-sex couples.
The document, titled: Your Government Respects Your Marriage: Developments in New York State Agency Recognition of Same-Sex Couples' Out-of-State Marriages, details many of the ways state agencies around New York accord legal respect to married same-sex couples. Lambda Legal, NYCLU, Empire State Pride Agenda and ACLU worked closely with state agencies to confirm and clarify the legal rights afforded to same-sex couples married out of state. The summary offers an overview of some of these statewide protections. "The guide is a crucial primer for same-sex couples who are recognized as spouses in New York," said Susan Sommer, senior counsel at Lambda Legal, who has litigated many of the cases confirming marriage respect for same-sex couples. "It shows significant areas in which these couples now are protected, ranging from access to health insurance, to accurate birth certificates for children born to same-sex couples, to important workers' compensation benefits if tragedy strikes. But until New Yorkers in same-sex relationships can marry in their home state, they are still vulnerable to discrimination." Read more

-Gay-bash suspect caught: Arrest ends weeks of turmoil for victim

Fort Lauderdale activist and video artist Stephen Velky can rest a little easier these days. Tuesday morning police arrested the 21-year-old man who allegedly bashed Velky Jan. 6. Police arrested Damian Nicholaus Serrano three weeks after Serrano allegedly attacked Velky in the front yard of Velky's home in Riverland. Serrano, who lives just two blocks away from Velky, was charged with aggravated battery and violating probation on a previous drug arrest. Police picked up Serrano at the county probation office.

On Monday, the Council, a quasi-official grouping of 700 Islamic clerics, decreed that Muslims should shun the ancient Indian practice. The clerics worry that Hindu-influenced chants and invocations might weaken Muslim believers' faith. The decree, though not legally binding, carries the force of moral authority, and, as is not uncommon in the Muslim world, the unspoken threat of enforcement by vigilantes.

Of all the slogans chanted and displayed at anti-Israel rallies over the past month, surely "Queers for Palestine" ranks as the most oxymoronic. It is the motto of the San Francisco-based Queers Undermining Israeli Terrorism (QUIT), a group advocating financial divestment from the Jewish State. QUIT contends that Zionism is racism, regularly demonstrates at gay pride marches, organizes with far-right Muslim organizations, and successfully lobbied the International Gay and Lesbian Human Rights Commission to boycott the 2006 World Pride Conference due to its location that year in Jerusalem. - "16 MEPs request the EU to act in protection of transgender people in Honduras."
On 29 November sixteen Members of the European Parliament sent a Parliamentary Question to the European Commission and the European Council expressing their concerns about recent murders of transgender people in Honduras and particularly the human rights defender Cynthia Nicole Moreno. "Has the European Commission discussed or have the intention to discuss the on-going violence against transgender people with Honduras´ authorities?" asked MEPs in the Question. Members of the European Parliament noted the fact that police in Honduras have been very reluctant to investigate murders and violence against transgender people. Three transgender women have been killed in recent month, but police have not found any of the perpetrators and NGOs working in the field states that there is a great risk that the perpetrators will never be found because of the negligence of the police.

The CIW is a worker's organization comprised chiefly of Latino, Haitian and Mayan Indian immigrants who work in Immokalee, Florida, largely as tomato pickers. Founded in 1993 as a "community-based worker organization" by a small group of discontented fruit pickers in low-wage agricultural jobs throughout Florida, the organization has won unexpected victories, achieved international notoriety and established fruitful collaborations with an array of grassroots groups, notably the Student-Farmworker Alliance.

Ted Haggard, one of the most influential Evangelical pastors in America until he got caught trying to buy crystal meth and homosexual sex from a male prostitute in 2006, will be grilled on Wednesday's Oprah. Unless Oprah is a better interrogator than the nation's TV writers, who got a crack at Haggard on the midseason press tour--an HBO documentary on him premieres Thursday at 8 p.m.--don't expect any juicy material. Haggard has talking point pat answers to questions such as "Are you gay?" and given what has happened to him, "Do you still condemn homosexual behavior?" This made his press conference with critics a real snooze. Since then, another man has come forward with accusations that he and Haggard had sex. Maybe Oprah can get something out of Haggard about that.

Former evangelical pastor Ted Haggard's wife says she knew about his struggles with same-sex attraction for years and felt he was "winning the battle" before a scandal involving a male prostitute triggered his downfall in late 2006. Gayle Haggard makes the remarks in an appearance with her husband on "The Oprah Winfrey Show" to air Wednesday. She said she was shocked when Haggard first told her the truth about the allegations against him. "The first words out of my mouth were, 'Who are you?'" she said, according to a publicity release issued Tuesday by Harpo Productions. However, Gayle Haggard also said her husband told her early in their 30-year marriage that he "struggled with some thoughts." "I felt it was the thing that could destroy Ted if he gave in to it," she said. "So I prayed for him and I felt as though he was winning the battle." Haggard, 52, resigned as president of the National Association of Evangelicals and New Life Church in Colorado Springs, Colo., after the male prostitute went public. Haggard confessed to "sexual immorality." The scandal widened in recent days with disclosures that Haggard also admitted to an "inappropriate" relationship with a church volunteer, Grant Haas, who was 22 at the time. Haas told KRDO in Colorado Springs that Haggard performed a sex act in front of him and sent him illicit text messages. He informed New Life Church shortly after the scandal broke, and the two parties reached a settlement in 2007 that included a confidentiality agreement. Haas went public as Haggard is heavily promoting an HBO documentary about his time in exile.

The California Court of Appeals so held yesterday. Doe v. California Lutheran High School Ass'n, 2009 WL 161869. Defendants successfully contended that they were not a "business" subject to California's anti discrimination law, because their high school was private, nonprofit, selective, and focused on religious education. Though the boundaries of what kinds of private entities are exempt from antidiscrimination laws can be a difficult one, it is undeniably a line that needs to be drawn somewhere, and it is hard to find fault with the court's ruling on that ground. (Note that this is a quite different question from whether entities that clearly are businesses can claim a religious exemption - the California Supreme Court has clearly said they cannot.)

-A 10-year campaign to censor the Internet ended last week when the Supreme Court refused to step in and save the Child Online Protection Act. Everyone can agree on the need to protect children from sexually explicit online material, but this misguided law tried to do it in ways that infringed on too much constitutionally protected free speech. Congress passed the Child Online Protection Act in 1998 after the Supreme Court had struck down an even broader law regulating online indecency. The 1998 act imposed civil and criminal penalties, including up to six months in prison, for offering commercial material online that was "harmful to minors."

This month, three teenage girls, students at Greensburg Salem High School in Greensburg, Pa., were charged with disseminating child pornography. They had sent nude pictures of themselves by cellphone to their teenage boyfriends, who were charged with possessing child pornography. The legal consequences in this case may have been unique, but the behavior is not. McDaniel's office says in a filing in the case that the attorney general will pursue every valid legal argument to defend the law, which went into effect Jan. 1 after voters approved the measure last November. The Arkansas Family Council, which led the campaign for the ban, says in its request to intervene that McDaniel might not rigorously defend the law because he opposed the measure last year. I doubt that most Christians knew what he was doing in either case, but Jews and Muslims did.

Now that precedent may be used to expel a number of gay Iranians from Sweden, to face imprisonment or death at home. Swedish asylum policy is governed by the Aliens Act of 1989. An amendment which came into effect in 1997 (Chapter 3, paragraph 3.3) explicitly includes gays and lesbians as a protected category, offering asylum to any person "who due to her/his sex or homosexuality experiences a well-founded fear of persecution."

Judge Robert L. Miller, a Reagan appointee who sits on the federal district court for the Northern District of Indiana, has recently issued yet another curious decision in the case of Creed v. Family Express Corp. Amber Creed was fired from her job in 2005 because she is transgender. [...] There is a considerable amount of debate as to whether, in protecting "gender identity" - one's self-identification as male or female - the law should also protect "gender expression" - one's expression of gender through clothing, styling and other behavioral and social characteristics. Judge Miller's decision in Creed I turned this debate on its head. He decreed that the federal sex discrimination protection extends to discrimination based on gender expression, but that discrimination based on gender identity is not. Under Judge Miller's rule, a crossdresser who makes no claims about sex would be covered, but a transsexual who claims to change their sex would not. In other words, sex discrimination covers a person whose sex is not implicated, but doesn't cover a person whose sex is implicated. Sheesh.

I think the whole issue of gay "marriage" would be easier to settle if people understood all marriages are at their most fundamental level civil contracts. You can sprinkle all the religious fairy dust on it you want, but it isn't legal unless you have a marriage license issued by the state. I've yet to hear any explanation, not even a silly one, of how same-sex marriage would be a threat to the "sanctity of marriage." Marriages have been disintegrating since biblical times without any help from the gay couple next door. If you think same-sex marriage is wrong, then don't do it. But what do you think gives you the right to tell two consenting adults how they can live their lives? Do you want me to tell you how to live yours? I think not.

Attorney Eddy McIntyre worked tirelessly for many South Florida groups and causes, including YES Institute, a nonprofit to prevent young gay people from killing themselves. What few knew: McIntyre himself suffered for years from depression and tried to commit suicide at least once in the early 2000s. The local gay community was shocked in 2007 when he hanged himself at age 47 inside his Miami Shores garage. His death illuminates an issue of particular concern to gays and lesbians.

A Dallas man who married his longtime partner in Massachusetts is asking a Texas court to grant him a divorce. It is believed to be the first time that a court in Texas has been asked to grant a divorce stemming from a same-sex marriage, although a court earlier refused to dissolve a civil union that had been obtained by another couple in Vermont. In that case, the judge cited the Texas constitution, which bans same-sex marriage.

-Tampa Area city council vetoes gay partner benefits
A proposal that could have led to health benefits for the domestic partners of Hillsborough County employees has been flatly rejected. Openly gay commissioner Kevin Beckner proposed a motion calling for a study into the feasibility of the benefits. Beckner, who was elected in November, said he proposed the idea now because the county is in the process of taking bids for employee health insurance. That process happens only once every four years.

A lot of people have been saying that Prop 8 was our side's to lose and that missteps by the No on 8 Campaign snatched defeat from the jaws of victory. Those analyses ignore hard core obstacles and fundamentals underlying the contest, including how hard it is to hold and move opinions on marriage in the narrow confines of a campaign. I need to start by saying that I had nothing to do with the No on 8 Campaign. Because the Evelyn & Walter Haas, Jr. Fund, where I work, has been so deeply involved in public education work in support of marriage equality, the law literally precluded any contact or coordination with the electoral campaign. So, as a purely armchair quarterback it's pretty easy for me to catalog things I - in my infinite wisdom - would have done differently. But I also know that even if everything- every single thing - had gone our way, it still would have been incredibly hard to win by anything more than a tiny margin. Here's why. -Los Angeles Affiliate KABC-TV Refuses to Air Ad With Gay Families During Inauguration: 'Too Controversial, Families Will Be Watching.' Non-profit organization GetToKnowUsFirst.org produced five 30-second commercials featuring gay and lesbian families, with the message "Marriage promotes families. Support marriage equality." The ads, while not tied to any current election, are the result of California's passage of Proposition 8 in November. The group aired the spots in 42 of the states' 58 counties -- everywhere the initiative passed by 50% or more -- during Tuesday's coverage of the Presidential Inauguration. KABC is the only station that refused to sell the ad space. The rejected ad profiles two African American men raising five children ages 6 through 25. Ironically, the family lives in Los Angeles.

Attorneys weigh in on demise of Child Online Protection Act

It was just a one-line reference in today's Orders list from the U.S. Supreme Court, under the heading "Certiorari Denied": "08-565 MUKASEY, ATT'Y GEN. V. ACLU, ET AL." But what it meant was that the Child Online Protection Act, better known simply as COPA, signed into law by President Clinton in 1998 but never enforced due to injunctions issued by the Third Circuit Court of Appeals, would never take effect. The last ruling on COPA was made on July 22, 2008, when a Third Circuit panel affirmed the trial court's decision that COPA was unconstitutionally vague and overbroad, and that technology had advanced to the point where end-user filtering software was a relatively effective method of protecting minors from exposure to sexually explicit materials - and in any case, a less restrictive method than the government had proposed in the original COPA legislation. If there is a clear message to come out of LGBT America's response to the fall election, that slightly modified line from the movie Network is it. Lesbian Christie Keith, who earns a living writing about pets, stepped out of her comfort zone to make that point in a Daily Kos diary. "We're no longer willing to settle for simply not getting beaten to death, for being able to live in our constricted safe zones without fear of baseball bats to the head and getting fired," she writes. This post-Proposition 8, post-Rick Warren fury is fueling Stonewall 2.0 activism. It is also one of the reasons we need a new gay agenda, especially in Washington, D.C. Our community's decades-old federal wish list is getting stale. It includes passing protection against job discrimination (the Employment Non-Discrimination Act), passing a hate-crimes bill, and repealing the Defense of Marriage Act and the "Don't Ask, Don't Tell" military policy. -Poll Show Shift in Attitude Toward Gays

(Washington) New polls taken in two of the country's most socially conservative states indicate a shift in attitudes toward LGBT people. A Florida poll shows a majority of prospective voters in that state believe the state's ban on gay adoption should be repealed and that there should be legal recognition of same-sex relationships, though they disagreed on whether that should be marriage or civil unions. The other poll, in Utah, found that a majority support LGBT civil rights. Both states in recent years have seen a large influx of new residents, primarily from the Northeast and California. In Florida, the poll by Quinnipiac University found that 55 percent favor abolishing the state law that prohibits gays from adopting, while 39 percent said the law should be maintained. Read more

-OH: Lambda Legal Defends Lesbia Mother in Ohio Custody Matter

In court papers submitted in the Ohio Eighth District Court of Appeals, Lambda Legal defended a lesbian mother in her fight to continue to parent her 11 and 8 year old sons. "These children have a right to the love and support of both of their parents," said Camilla Taylor Senior Staff Attorney in Lambda Legal's Midwest Regional Office in Chicago. "The Ohio Supreme Court already has said that Ohio's antigay constitutional amendment does not prevent a same-sex couple from sharing custody of the children they are rearing together. We shouldn't have to address this hurtful and discriminatory argument any longer. The trial court below in this case did the right thing by focusing on the needs of the children, and awarding shared custody to these women based on more than a century of Ohio case law allowing such orders." Lambda Legal represents Rita Goodman in her pursuit to continue to parent her two sons. Goodman and her former partner Siobhan LaPiana were in a committed relationship for 10 years. During that time the women planned and had two children. LaPiana gave birth to the children but both women equally parented the boys, who love and rely on both of them as their mothers. Before the birth of the first child, Goodman and LaPiana drafted and signed a parenting agreement detailing their intent to share all responsibilities of parenthood. After the couple split, LaPiana began restricting Goodman's time with the boys. In February 2007, Goodman filed a lawsuit, and in August, 2008, the trial court ordered visitation for Goodman. LaPiana appealed, arguing, among other things, that Ohio's antigay constitutional amendment prevents courts from entering orders permitting former lesbian partners to share custody, and that the court's order unconstitutionally infringed on her right to autonomy as a parent. -LA: Decision Upholds Benefits for Same-sex Partners of City Employees

The city of New Orleans acted legally in the 1990s when it created a registry for same-sex couples and used it as a basis to provide health insurance for the partners of its gay and lesbian employees, a state appellate court ruled last week. In a unanimous decision, a trio of 4th Circuit Court of Appeal judges turned back claims by the Alliance Defense Fund on behalf of six New Orleans residents that the registry violates state laws against same-sex marriage and that local governments have no authority to govern such arrangements. In its 20-page ruling, the panel said the city's domestic partnership registry ordinance "has no effect on the (state) Civil Code articles relating to marriage, creates no obligations between the parties who choose to register and provides neither an enforcement mechanism nor a cause of action for which redress may be sought in courts of this state." Truth Wins Out (TWO) today called on Colorado officials to investigate New Life Church, after the Associated Press revealed that New Life paid money to keep a male volunteer from publicly disclosing a romantic affair with the church's former minister Ted Haggard. According to the AP, New Life's current Senior Pastor, Brady Boyd, said that the church reached a legal settlement to pay the man for counseling and college tuition, with one condition being that none of the parties involved discuss the relationship publicly. "Until conservative churches stop shaming gay people and learn to accept them, we will see more tawdry scandals," said Truth Wins Out's Executive Director Wayne Besen. "These calamities are a direct result of the closet." Rev. Boyd denied that New Life paid hush money and said, "Our desire was to help him. Here was a young man who wanted to get on with his life. We considered it more compassionate assistance - certainly not hush money." TWO called on Colorado officials to look into the matter.

We're getting perilously close to closing the window on a two-state solution, because the two chief window-closers - Hamas in Gaza and the fanatical Jewish settlers in the West Bank - have been in the driver's seats. Hamas is busy making a two-state solution inconceivable, while the settlers have steadily worked to make it impossible. During a recent trip to Tehran, I noticed that the Benetton shop in my old neighborhood of Darrous was closed, its windows papered over. In the past, fundamentalists offended by the shop's immodest displays had decried its immorality and spread rumors of "Zionist ownership." This time, however, they set the place on fire -- not to protest the mannequins, dressed in the latest fashions, sans veils, but rather to protest the carnage in the Gaza Strip. Though my visit happened to coincide with the Israeli offensive that killed an estimated 1,300 Palestinians over three weeks, I hadn't expected the conflict to reverberate in my old neighborhood. If anything, I've always found that my former neighbors -- many deeply pious, but not known for any special antipathy toward Israel -- are, like the majority of Iranians, resentful of Iran's support for militant groups such as Hamas and Hezbollah.

'Libs,' 'pinkos' and 'right-thinking Americans' in the Bush Justice Department
BEFORE THE BUSH era passes too far into history, take a moment to peruse yet another devastating report about politics run amok at the Bush Justice Department. The subject is personnel decisions in the department's Civil Rights Division. The report, which was released publicly on Jan. 13, was prepared by the Office of Inspector General and the Office of Professional Responsibility. The findings are, in a word, disgusting. Supervisors in the division routinely weighed political affiliation or ideology in hiring for career positions, which is a violation of federal civil service laws. Managers referred to some employees hired during Democratic administrations as "libs" or "pinkos." When making hiring decisions, one supervisor, Bradley Schlozman, in conversations and e-mails, stated a preference for hiring conservatives -- or, in his parlance, "right-thinking Americans" (whom he also referred to as "RTAs"). According to the report, roughly 64 percent of those Mr. Schlozman hired were considered Republican or conservative; 2 percent had more liberal or Democratic credentials, and the political views of 34 percent were unknown.

Is Jeb Bush now only qualified to be president? Sadly, his recent refusal to seek Florida's open Senate seat race in 2010 indicates, the answer is "yes." Jeb's decision not to run is beyond disappointing to national and Senate Republicans in dire need of reinforcement. It is also an example of "president-itis," which afflicts prominent Republicans from time to time. Despite advantages to themselves and their party, too often Republicans who see themselves as "presidential" can not see themselves in any other light.

-Crist praises Obama's promised stimulus package

West Palm Beach - Gov. Charlie Crist told a crowd of 700 today the stimulus package promised by President Barack Obama offers hope on the heels of severe budget cuts. Though the state just released figures showing 8.1 percent unemployment, Crist told the nonpartisan Forum Club of the Palm Beaches, "There are legitimate reasons for optimism even in the difficult economy we are slogging through."
