Shealso contends that authorities would be more aggressive if the complaintwere being made by a person in a heterosexual marriage.

Trustee Stephen Cassidyhas suggested a resolution for the board to oppose Proposition 8, which ifpassed by voters in November would ban gay marriage in California. Theboard has not acted on the proposal, except to pass the matter on to anadvisory committee for further discussion. Proposition 8 might seem to haveno direct impact on education. But Cassidy said his reasons have to do withthe board's duty to defend the state constitution, and to protect theintegrity of the board's efforts to promote inclusiveness on its campuses.If the proposition passes in November, Cassidy said, he could not agree with"discriminatory language in the California constitution."

To read Obama'sexams is to get a glimpse of the supple intelligence he would bring to thepresidency and to be impressed by his lawyerly capacity - perhaps evencompulsion - to see the other side's argument and mine the weaknesses of hisown case.

-Sexual Assault in the Military: A DoD Cover Up?
There was quite a struggle in Congress this week. The Department of Defenserefused to allow the senior civilian in charge of its Sexual AssaultPrevention and Response Office (SAPRO) to testify in Thursday's hearing onsexual assault in the military. Rep. John Tierney, chair of the HouseSubcommittee on National Security and Foreign Affairs, angrily dismissedPrincipal Deputy Undersecretary of Defense Michael Dominguez from thehearing when Dominguez said that he, the DoD chief of legislative affairsand the chief of public affairs, had ordered Dr. Kaye Whitley, chief ofSAPRO, to refuse to honor the subpoena issued by the subcommittee for herappearance. Full committee Chairman Henry Waxman called the DoD'sdecision to prevent Whitley from testifying "ridiculous and indicating DoDis covering something up." It could also place Whitley in contempt ofCongress. Rep. Christopher Shays said the DoD's decision was "foolish."

-The German Constitutional Court just declared the provision in the GermanTranssexual Law (Transsexuellengesetz TSG) which demands forced divorce oftranssexuals unconstitutional. The TSG demands that transsexuals who legallywant to change their gender marker on their birth certificates have to beunmarried (though a registered partnership was no hindrance). This part ofthe law has just been declared unconstitutional and may not be used untilthe German government proposes a new solution.
