-Florida judge allows gay man to adopt foster children, calls ban illegal
A Miami trial judge's ruling allowing a gay man to adopt two foster children appears headed for the Florida Supreme Court and a test that could overturn the last complete ban of gay adoption in the nation. "There is no rational basis to preclude homosexuals from adopting," Judge Cindy S. Lederman said Tuesday in a Miami-Dade County juvenile courtroom, declaring Florida's 31-year-old ban on gay adoption illegal. She cited expert testimony saying there is no sound science to justify the ban. Upon hearing the judge's words, Frank Martin Gill patted his eyes with a folded white tissue, grateful for the opportunity to permanently parent the children he and his partner have raised since just before Christmas 2004. [...] "This is heartbreaking, this is horrible," said the Rev. O'Neal Dozier, founder of the Worldwide Christian Center Church in Pompano Beach. "This is one of the worst cases of judicial activism we could ever see." Children should not be exposed to two men living as spouses, Dozier said. "It disturbs, for life, young impressionable minds."

-Florida ban on gay adoptions ruled unconstitutional
A Miami-Dade circuit judge Tuesday declared Florida's 30-year-old ban on gay adoption unconstitutional, allowing a North Miami man to adopt two foster kids he has raised since 2004. [...] Moments after Lederman released the ruling, attorneys for Florida Attorney General Bill McCollum announced they would appeal the decision to the Third District Court of Appeal in Miami. ''We respect the court's decision,'' said attorney Valerie Martin, who had argued in support of the ban during a weeklong trial Oct. 1-6. But, she added: ``Based upon the wishes of our client, the Department of Children & Families, we have filed a notice of appeal this morning.'' [...] Gov. Charlie Crist, a former attorney general who has expressed support for the adoption ban, declined to comment Tuesday, saying he hadn't yet reviewed the ruling.

-Florida, U.S. Sugar reach deal on Everglades land
The proposed contract marks the culmination of five months of closed-door talks and deviates little from terms already publicized, including that the state will pay $1.34 billion for 180,000 acres of sugar land to restore water flows from Lake Okeechobee to the Everglades. "This acquisition represents one of the most important opportunities to protect the Everglades ecosystem in recent years," Michael Sole, secretary of the Florida Department of Environmental Protection, said during a conference call Tuesday.
